CareAI Terms of Use (English)

Governing Language: In case of discrepancy between translations, the English version prevails.
These Terms of Use ("Terms") govern your access to and use of the CareAI mobile application and related services ("CareAI", "Service"). By creating an account or using the Service, you agree to these Terms.
1. Who we are
CareAI is operated by the CareAI owner/operator ("we", "us").

2. Eligibility and accounts
- You must provide accurate account information and keep it updated.
- You are responsible for maintaining the confidentiality of your credentials and all activity under your account.
- You must not use another person's email or identification information.
3. Service purpose and limitations
CareAI supports seniors, caregivers/family members, and medical professionals with features such as reminders, logs, and communication tools.
CareAI is not a medical device and does not provide medical diagnosis or treatment.
You should seek professional medical advice for any health questions.
CareAI does not provide medical advice, treatment recommendations, or clinical decision support. Users remain responsible for following instructions provided by their healthcare providers.
3.1 Medical Information Disclaimer
No Medical Advice / No Diagnosis / No Treatment:
- CareAI provides informational content only, including medication information sourced from public databases (such as OpenFDA). This information is for educational and reference purposes only.
- CareAI does not provide dosing recommendations, prescribing guidance, or diagnostic services.
- CareAI does not replace professional medical judgment, consultation with qualified healthcare providers, or emergency medical services.
- Any medication information displayed in the app, including information from FDA/OpenFDA sources, is informational only and should not be used to make medical decisions.
3.2 Third-Party Independence
- Doctors act independently: When you use the "Ask My Doctor" feature, any responses or communications from linked Doctors are provided by those Doctors in their independent professional capacity. CareAI is a facilitator only and does not control, endorse, or assume responsibility for the medical advice, opinions, or actions of linked Doctors.
- No agency relationship: Linked Doctors, Guardians, and other care team members are not agents, employees, or representatives of CareAI.
4. Emergency and safety
CareAI may include SOS or emergency-related features. These features may fail due to connectivity, device limitations, permissions, or third-party dependencies.
Do not rely solely on CareAI for emergencies. If you believe there is an emergency, call your local emergency number immediately.
4.1 No Emergency Service Guarantee
- No guarantee of detection accuracy or response time: CareAI's distress signal detection and escalation features are provided on a "best effort" basis. We do not guarantee that all distress signals will be detected, that notifications will be delivered immediately, or that care team members will respond in a timely manner.
- Not a substitute for emergency services: CareAI is not a substitute for calling emergency services (e.g., 911, 112, or your local emergency number). In any emergency situation, you should call emergency services immediately.
- Technical limitations: Escalation notifications may be delayed or fail due to network connectivity, device issues, app permissions, or other technical limitations beyond our control.
5. User roles and invitations
The Service supports different user roles (e.g., Senior, Family/Guardian, Doctor/Professional). Some relationships may require invitations and approvals.
You agree to:
- Only invite or link accounts where you have the right and authorization to do so.
- Use the Service in a lawful, respectful, and non-abusive manner.
6. Acceptable use
You must not:
- Attempt to access data you are not authorized to access.
- Interfere with or disrupt the Service or security controls.
- Upload malware, exploit vulnerabilities, or attempt to reverse engineer protected components.
- Harass, threaten, or abuse other users.
7. Privacy
Your use is also governed by the CareAI Privacy Policy (English). Please read it carefully.
8. Content and communications
You remain responsible for the content you submit (e.g., messages, notes, profile details).
We may use automated systems to deliver features (e.g., reminders or suggestions). See the AI Transparency Notice.
9. Subscriptions and payments
If paid plans are offered, fees and billing terms will be presented in the app at the time of purchase. Taxes may apply. Refund eligibility is governed by the applicable app store policy and local law.
10. Intellectual property
CareAI and its branding, code, and content are owned by us or our licensors. You receive a limited, non-exclusive, non-transferable license to use the Service for personal use in accordance with these Terms.
11. Service availability and changes
We may modify, suspend, or discontinue the Service (in whole or part) at any time. We may also introduce limits or restrictions for security, compliance, or operational reasons.
12. Termination
We may suspend or terminate access if you violate these Terms or if required for security/compliance. You may stop using the Service at any time.
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". WE DISCLAIM ALL WARRANTIES TO THE EXTENT PERMITTED BY LAW, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
14. Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill.
14.1 Health and Safety Features
Limitation of Liability Related to Health and Safety Features:
- No liability for medical outcomes: CareAI is not liable for any health outcomes, medical decisions, or consequences arising from your use of medication information, "Ask My Doctor" features, or any other health-related features in the app.
- No liability for escalation failures: CareAI is not liable for any consequences arising from failures, delays, or inaccuracies in distress signal detection, escalation notifications, or care team responses.
- No liability for third-party actions: CareAI is not liable for the actions, omissions, advice, or communications of linked Doctors, Guardians, or other care team members who use the Service.
- User responsibility: You acknowledge that you are solely responsible for your health decisions and for seeking appropriate professional medical care when needed.
15. Governing law
These Terms are governed by the laws and regulations applicable in the Kingdom of Saudi Arabia, to the extent applicable, and any mandatory consumer protections remain unaffected.
16. Changes to these Terms
We may update these Terms from time to time. The updated version will be available in the app with a revised effective date.
